Appendix I: Statement on Faculty Discipline - Rights

Faculty discipline cases involving Title IX issues shall provide for certain equitable rights for a student complainant, specifically:

• The right to receive a copy of the charges filed with the Advisory Board.

• The right to present evidence at the Evidentiary Hearing, subject to the provisions relating to the submission of proposed exhibits, witness lists and summaries, and motions to exclude evidence.

• The right to respond to evidence presented.

• The right to have an advisor provided by the University.

• The right of briefing and argument in connection with the Final Hearing.

• The right to request information from the University regarding the matter.

• The right to receive notice of the stages of the process, and notice of the outcome at each stage that is the same as the notice provided to the faculty member.

In addition, the process from initiation of the investigation through the decision by the President shall be completed within 110 days, with specific guideposts in between to be decided by the Advisory Board. The expectation is as follows:

The University investigation will be completed in a maximum of 30 days (Day 30).

If necessary, charges will be filed within a maximum of 7 days of the completion of the investigation (Day 37).

The Evidentiary Hearing, including findings of fact, will be completed within a maximum of 43 days of the charges being filed (Day 80).

The Advisory Board will render its decision (following the Final Hearing before the Advisory Board) within a maximum of 25 days after the completion of the Evidentiary Hearing and findings of fact (Day 105).

The President will make a decision within a maximum of 5 days of the Advisory Board decision

(Day 110).

The foregoing timeline may be subject to modification due to special circumstances, including the complexity of the matter.
